New Photo Stock Site for 2007

General Overview
We have a new photo website this year. Shutterstock.com. As many of you have seen, the selection and quality of images this website offers is unmatched in the industry today. However, this overwhelming selection does come at a price.

Shutterstock offers their group rate differently than most other sites. We have negotiated a rate to purchase 65,000 images for use this year with each artist having their own login account to access these images. With 121 artists, and 260 working days a year, that will average out to be around 2 hi-res image downloads per day, per artist. (10 per week, 40 per month). This will be more than sufficient for some users, but maybe not enough for others. Hopefully the numbers will balance out in the end.

In an effort to make these images go farther, we must start using the COMP IMAGES for all art that is not pre-sold. Spec art should not utilize hi-res images until it becomes sold art. We can not afford to download high-res files for every piece of spec art created. I know this goes against the way we typically work, especially here in CAP, but this is the only way to get the superior selection of images that Shutterstock has to offer. So again, please cut corners when you can. Realizing that sometimes you must work on a high-res image for designs with extensive photo manipulation, we ask you to keep this the exception and not standard operating procedure.

As a supplement to Shutterstock, I highly recommend utilizing the many free resource sites such as http://www.sxc.hu, http://www.qualitagious.com, and http://www.pixmotor.com. There are also low cost pay sites like http://www.istockphoto.com as well if your plant is willing to absorb the cost for the subscription.

The total usage for images last year from Photos and Photo Objects combined was 49,002 (as of 3-26-2007). Based on these numbers, Shutterstock should work, especially with the additional resources like the ones mentioned above.

Please also understand that Lamar Graphics will not be purchasing any additional images before April 5th 2008. If all of downloads are used before then, each plant will then be responsible for providing their own image stock.


Terms of Use
These are the following Terms of Use agreed to by Lamar Graphics.

This letter when signed on behalf of each of the parties hereto shall constitute an amendment to Shutterstock, Inc.’s Standard License, Terms of Service (“TOS”). http://www.shutterstock.com/licensing.mhtml

All capitalized terms used herein shall have the meanings ascribed to them in the TOS unless such terms are separately defined in this amendment

The legal sufficiency of which is acknowledged by the parties, Shutterstock, Inc. (“Shutterstock”) grants to Lamar Advertising Company (“Lamar”) the following additional rights in and to the Shutterstock service and Shutterstock’s Images:

1. The term of Lamar’s subscription shall be for a period of one (1) year, from 6th April 2007 through 5th April 2008 (the “Term”);

2. Lamar shall have a period of six (6) months following the expiration of the Term to use Images downloaded during the Term (the “Usage Period”). Please see paragraph 16 of the TOS.

3. Lamar’s account may be accessed by up to one hundred thirty (130) designers employed by Lamar (”Authorized Employees”);

4. Lamar’s Authorized Employees may download up to sixty five thousand (65,000) Images during the Term;

5. In addition to the permitted uses set forth in the TOS, Lamar may use the Images in accordance with the TOS in up to fifty (50) “high traffic” locations. For the purposes of this amendment, a “high traffic” location is defined as any location with a Daily Effective Circulation of 8,334 or higher.

6. Each time an Image is used by Lamar in a high traffic location, Lamar will notify Shutterstock, via email, of the Shutterstock ID Number, the Shutterstock submitter name and the location of the advertising medium. Such notification shall take place, in each instance, no later than five (5) days following the commencement of the “flight” or display period of the medium incorporating an Image.

7. Lamar will not use any Images designated “Editorial” without first obtaining all necessary consents, permissions and licenses;

8. Lamar will use its best efforts to prevent its employees from using any Images for their own personal or commercial use.

9. Lamar will provide Shutterstock with the names of the Authorized Employees upon Shutterstock’s reasonable request.

10. Upon the expiration of the Usage Period, Lamar will destroy all copies of Images in its possession that were not used during the Usage Period except for those copies it retains in the normal course of its record keeping.

Explanation of Terms
Here’s the low down on each of the items listed above in layman’s terms.

1. Self explanatory.

2. If a hi-res image is downloaded and used in spec art, you will have 6 months to use this image if the design/art is sold.

3. Everyone will have their own account so we can track who is using what.

4. This is the total number of high-res images ALL of Lamar is allowed to download in the contract year.

5. Included in this contract is 50 high traffice image licenses. This means we can use up to 50 images on structures with a DEC of 250,000 or more. A list of these structures can be found at the bottom of this document.

6. If you use and image on any of the indicated “high traffic” structures, please email me (mrankin@lamargraphics.com) the image #, Panel #, and how long the design will up. I will forward this information to the Shutterstock so their photographers will get the bonus pay for these uses. Please notify me within 5 days of posting. If you fail to notify LG within 5 days, your plant will be responsible for any costs/fees incurred for the use of this photo.

7. Some images are marked as editorial and permission of use will be needed from the photographer. These images are marked as Editorial Use Only in the Release info line. You can click on the copyright name above to email the owner of the image to obtain permission. Just tell them how you plan on using the image and they will grant or deny permission base on that info.


8. These images are for Lamar business only. Do not download them for personal or freelance use. Anyone found doing so will be denied access to the account for the rest of the contract term and your plant manager will be notified.

9. I will provide a list of all Lamar artist to Shutterstock. The accounts will be set up from that list.

10. 6 months after the contract expires, all stock piled images that have not been used in Lamar art must be deleted. This does not include images used in our designs, but does include images used in spec art that was never produced. If an image was used for Lamar business, the design that contains that image may be used perpetually as long as it stays intact with that design. Basically customers can reorder designs indefinitely after the contract expires. As long as the images were used within the year and 6 months of the contract, you can continue to use them for that client.

 

Account Management

Shutterstock is a small company and can not handle tech support for such a large group. Lamar Graphics has been asked to be the sole contact for account information, management and trouble shooting. That means Lamar Graphics will have to process all issues pertaining to Shutterstock support. If you are having trouble with your account please contact me (mrankin@lamargraphics.com or 225.923.3113) and I will get back with you as soon as possible. I’ll contact Shutterstock and return a resolution as quickly as possible.

In addition to the tech support issues, Lamar Graphics will also be managing each account to help insure our pool of images lasts all year. We will be monitoring account usage on a bi-weekly or monthly basis. If we spot abusers in the system that go well over the allotted amount, Lamar Graphics reserves the right to temporarily or permanently lock individual accounts from downloading high-res images. You will be warned if your number of downloads is reaching excessive amounts prior to locking your account. Persistent abuse will result in the loss of your account. This will only be done as a last resort for repeated offenders.

Additional Pay-Per-Piece Photo Resources.

Istock Photos offers a great deal of additional content at a VERY affordable price. They are about the cheapest alternative to any per piece based photography sites on the internet today. High quality downloads ranging from $1 - $40 a piece. This is practically unheard of pricing for royalty free imagery. They operate on a credit system, you purchase X number of credits and use them as needed. Credits are valid one year after purchase.

There are also many other Royalty Free Stock Photography companies available online. Here is a small list of additional companies that provide additional content and sell photography on an individual basis. Prices vary greatly from company to company so be sure to check them carefully. Prices typically range from $90 to $300+ per image. They are expensive but they are the top players in the Stock Photography industry. If your client absolutely has to have the "perfect" picture and they are will to pay for it, chances are one of these sites may have it available for purchase. These sites are only recommended as a last effort because of the price.
